Are you the decision maker in the NHS or Local Authority for someone who may lack the capacity to make their own choices? The person could lack the capacity as a result of being unconscious, having a learning disability, acquired a brain injury, have mental health problems, dementia, for example.
Mental Capacity Advocacy (IMCA) services in England and Wales started on 1st April 2007, as required by the Mental Capacity Act 2005. HUBB is the statutory IMCA provider for Havering, Barking and Dagenham.
HUBB’s IMCAs will advocate on behalf of the person and provide a report on their findings to assist the decision-making process.
CRITERIA FOR USING THE IMCA SERVICE
By law, every Local Authority / NHS MUST instruct their local IMCA to represent anyone in their area WHO
is over 16 years old and lacks capacity (as defined by the Act)
AND
is without family or friends suitable to help in the
decision-making process.
WHENEVER their staff are involved in making a decision for this person about
giving or withdrawing serious medical treatment (for example, chemotherapy or surgery)
OR
supporting a significant change of residence (for 28 days or more in hospital or more than 8 weeks in a care home)
An IMCA MAY also be instructed for Care Reviews and certain Adult
Safeguarding cases.
Early instruction is essential to the successful outcome of advocacy intervention!

Instructor/Decision Maker signs Instructor Form and forwards to HUBB before any IMCA involvement
IMCA meets client and liaises with Instructor/Decision Maker regarding action proposed
IMCA liaises with Instructor/Decision Maker regarding next step(s) for IMCA and others
IMCA sends final report and service evaluation form to Decision Maker
Decision Maker informs IMCA of outcome, completes and returns HUBB service evaluation form
